Open the Book Guidance

The Safeguarding Team has received a number of requests for clarification in relation to the eligibility of Open the Book volunteers for DBS checks and has considered this carefully.

Our advice is that it appears that they are eligible for an enhanced DBS disclosure without barring. In technical terms it is because they work as supervised volunteers in a ‘Specified Establishment’ (see page 15 of Safer Recruitment) and the frequency criteria do not apply as eligibility for regulated activity is informed prior to the relevant sections in the Protection of Freedoms Act 2012.

In effect, the provision under The Police Act 1997 (Criminal Records) Regulations 2002 r5C(i) (as amended) still applies; it states that those engaging in ' done infrequently which, if done frequently, would be regulated activity to children within the meaning of Part 1 of Schedule 4 to the Safeguarding Vulnerable Groups Act 2006 or as it had effect immediately before the coming into force of section 64 of the Protection of Freedoms Act 2012’ will be eligible for an enhanced check.
